
Rules and Disclaimers
Marine Exploration Inc., a publically traded company (OTCBB: MEXP) invites you to participate in its Treasure Quest Challenge. We encourage submission of locations that display coordinates within the following geographical areas: In the Caribean Sea from South America North to Bahamas South, West of West West Indies, and from Central America East.
Eligibility, entry period and instructions, judging criteria, prize details and winner selection and notification procedures are detailed below. BY PARTICIPATING IN THIS CHALLENGE, YOU FULLY AGREE TO ALL OF THE RULES OF THIS CHALLENGE AND TO ALL OF THE LEGAL TERMS AND CONDITIONS LISTED BELOW.
ELIGIBILITY
This Challenge is open to all individuals over the age of eighteen who possess a valid passport. No purchase is necessary to enter the contest.
This contest is void where prohibited by law.
ENTRY PERIOD
The Challenge begins March 14th, 2009, 12 PM EST and ends October 31st, 2009, 4 PM EST. All entries must be received within this time period in order to be considered for prizes. Marine Exploration, Inc. reserves the right to modify the deadline for submissions due to circumstances beyond its control.
ENTRY INSTRUCTIONS
Please enter the contest by registering for membership at www.treasurehunterchallenge.com, joining the "Treasure Hunter" Group and/or submitting your map coordinate details electronically at This e-mail address is being protected from spambots. You need JavaScript enabled to view it . Entrants must complete all data requested on the form. No other method of entry will be accepted. We will not accept entries submitted through the mail.
You may submit as many map coordinate details as you wish with your entry; however, you may only enter once per valid e-mail address. Coordinates must be submitted in JPEG format (as .jpg files) and should be at least 1MB but shall not exceed 5MB. You must submit the actual image file, not a link or other type of file. If an image file is not readable, the entry will be disqualified. Altered map pictures or coordinates will not be accepted. Electronic files submitted to Marine Exploration, Inc. will not be returned and may be retained by Marine Exploration, Inc.
By entering, you warrant that the map coordinates that you submit are original and that they do not infringe on the rights of any third party. You further warrant that your participation in this contest does not violate any agreement between you and a third party. Any coordinates submitted that are currently a part of a valid third party survey/salvage contract of another corporation, individual or entity, shall be disqualified.
By entering the Challenge, you grant Marine Exploration, Inc. the exclusive right to publish, use, distribute, reproduce and publicly display your submission, and to create derivative works from same.
You will be registered for one (1) additional Challenge entry for every qualified individual that you refer to the Challenge.
JUDGING CRITERIA
After the close of the entry period, eligible submissions will be judged based on presentation, accuracy, research and supporting documentation.
WINNER SELECTION & NOTIFICATION
On or about December 1st, 2009, Marine Exploration, Inc. shall notify each winner of his or her selection. Notification shall be by e-mail and/or telephone. If Marine Exploration, Inc. is unable to contact a potential winner, does not receive an acknowledgment of receipt from a potential winner within ten (10) days, or if the notification is returned as undeliverable, Marine Exploration, Inc. has the option to disqualify such potential winner and select an alternate winner.
One Grand Prize Winner will be selected:
The Grand Prize Winner will receive round trip tickets for two (2) to the Dominican Republic, a three day, four night hotel stay, transportation to and from the airport, a $200.00 per day entertainment stipend, and a personal tour of the R/V Hispaniola. Additionally, the Grand Prize Winner will have his or her map coordinates submission analyzed for survey and salvage and will be entitled to five percent (5%) of the net recovery realized by Marine Exploration, Inc. on said survey and salvage, if any.
Ten (10) Runner Up prize winners will be selected:
Each Runner Up prize winner will receive a Gold Coin, together with Certificate of Authenticity, from one of Marine Exploration, Inc.’s Dominican Republic Recoveries.
All foreign, federal, state and local taxes, fees and surcharges on prizes, if any, are the sole responsibility of the prize winners.
Prize winners will be required to execute and return to Marine Exploration, Inc. an Affidavit of Eligibility/Release of Liability/Prize Acceptance Form ("Affidavit and Release") within ten (10) days of notification of selection as a prize winner. The Affidavit and Release will, among other things and as required under these contest rules, certify the prize winner's eligibility to enter the contest; release and indemnify Marine Exploration, Inc. from and against liability associated with the entry, and the prizes; acknowledge responsibility for taxes; and certify compliance with the U.S.A. Patriot Act and related anti-terrorism laws. Failure to sign and return an Affidavit and Release to Marine Exploration, Inc. within ten (10) days of notification may result in disqualification and the selection of an alternate winner.
LEGAL TERMS & CONDITIONS
This contest is subject to all applicable federal, state and local laws and regulations.
As an entrant in this Challenge, it is your responsibility to determine that you are eligible to enter and to comply with the entry instructions and other Challenge rules set forth herein. Any violation of the Challenge rules may result in your disqualification.
This Challenge is void where prohibited by law. By entering the Challenge, you confirm that you have read and agree to all of the Rules and Regulations applicable herewith.
In the event that two or more entrants submit the same or substantially similar coordinates, Marine Exploration, Inc. solely reserves the right to select a winner from said entries. There will be no ties. Marine Exploration, Inc. shall base its selection of a winner upon numerous factors including, but not limited to, the date of the entry and the amount of legitimate supportive data submitted with said entry.
By submitting an entry to this Challenge, you grant Marine Exploration, Inc. the exclusive, non-revocable right to publish, use, distribute, reproduce and publicly display your submission, and to create derivative works from same. You release and hold harmless Marine Exploration, Inc. from any and all liability associated with the use of said submission. All intellectual property rights vest in Marine Exploration, Inc. upon submission.
